RULE MAKING DOCKET  (ACT 401 Compliance)


 In accordance with Louisiana Revised Statute 49:974, the Department of Transportation and Development, has published their rulemaking documents to inform the public of the proposed rules and policy provisions approved by the department.  

   NOTE: The notices accessible on these pages are subject to revision by the Office of The State Register.  Any requests for certifiable copies of the rules should be directed to the Office of State Register, who maintains the Louisiana Administrative Code and the Louisiana Register.

PROPOSED RULES

  • ​​​Weights and Standards (LAC 73) 

23 C.F.R. § 657.5 requires the State to enforce vehicle size and weight laws.  Pursuant to 23 C.F.R. § 657.19, if such laws are not enforced, the State risks losing ten percent of its federal transportation funding apportionment. This responsibility for enforcement at stationary scales was transferred to DOTD on July 1, 2022. This proposed rule provides updated procedures for enforcement of vehicle size and weight laws, and provides for compliance with federal laws regarding vehicle size and weight laws.​

Pursuant to La​. R.S. 49:968(K), DOTD submits a Yearly Action Report relative to the adoption, amendment, or repeal of any rule or the adoption, increase, or decrease of any fee during the calendar year to the appropriate legislative committee.
